Ms. He reported that her company had frequently suffered power cuts recently, which affected normal operations.
Ms. He said the company she works for provides investment promotion services. Starting in 2013, it rented buildings in the Jinhua Heyi E-commerce Industrial Park and then subleased the space to others for office use. At present, there are about 12 floors and around 100 rooms.
In March this year, the park welcomed a new landlord through a judicial auction.
Ms. He: The auction was on March 13, the ruling was issued on March 27, and the ownership could change. Then on April 17, the new property owner's new property certificate was issued. My money was paid to the former property management in March, including in February, about 400,000 yuan.
Ms. He said the property her company leased had not yet expired, and sale does not break lease. After multiple rounds of negotiation, the new landlord agreed on the afternoon of August 27 to first continue performing according to the original contract.
Ms. He: In early September we were going to open a notarized account and pay 1 million yuan into it first, then gradually by the end of September, the end of October, and the end of November, until the 3 million yuan was fully paid. Because the full annual rent in our contract with them, in terms of money alone, is 3.38 million yuan. After we reached an agreement that afternoon (August 27), it was already 5 or 6 p.m. At 7:10 p.m., suddenly the 1st, 3rd, 5th, and 7th floors of my Building A9 had their power cut. The matter of paying 1 million yuan into the notarized account in early September, he went back on it. He said it could not be paid into the notarized account and must be paid into their account. Under pressure because our clients had no electricity, we agreed.
Ms. He said that after paying 1 million yuan in rent, the new landlord did not cooperate with them in helping tenants register companies.
Ms. He: After the 1 million yuan was paid, shouldn't you give me the materials for company registration the next day? Why? Because this is my lifeline. I do investment promotion services here and act as a secondary landlord. I pay you millions in rent, bring in investment, and shouldn't my clients register companies? Because of this, it caused very great obstacles to serving my old clients and bringing in new clients.
According to the agreement, on September 10, Ms. He's company paid another 500,000 yuan in rent.
Ms. He: Until September 18, he said the 500,000 yuan at the end of the month had become 1.5 million yuan. He combined the last two installments, meaning you must pay it all off in one lump sum. We said the pressure was a bit too much, because after all it had been half a year, and our investment promotion had not gone smoothly. From March until now, my investment promotion has been consistently unsuccessful, just because there were no company registration materials. He mentioned 1 million yuan. He said it was fine if you do not pay, but you have to put up collateral, like a property certificate. We said no, that is unreasonable. We still hoped to follow the agreement and normally pay 500,000 yuan. He then said 800,000 yuan was also fine, and that I should put up 700,000 yuan in collateral. He said after you pay, I will give you the company registration materials. Do you think I would still believe him?
Ms. He said the company decided not to rent anymore and on September 23 sent the other side a letter to clear the premises. They calculated that, based on the rent already paid, the venue should be usable until around November 19.
Ms. He: They listened, but in the end they just went to report and seek approval, and in the end there was no result at all. I thought the worst case was that you sue me and we go through the judicial process, but I did not expect that at 8:17 a.m. on October 1, the power was cut. After coordination by the community and the police station, it was not until October 4 that all 12 affected floors fully had power restored.
Ms. He: From the 1st to the 4th of October, was that act over? After it was over, on the 5th, he stuffed a piece of paper into the rooms of all my clients. He meant that I owed him rent, so he cut the power, and told the clients to come to me. Then until 8 a.m. yesterday, all power was cut, and all 12 floors lost power again. It seems one floor, A9 sixth floor, was not cut off. I do not know whether it was a fish that escaped the net or what. Up to now it still has no power. Now I am saying that communication is communication, we can negotiate, the community can intervene, the government can intervene, and the media can also intervene, but the power should be restored first and not affect clients. Because these people come from all over to make money, right?
When the reporter arrived at the scene, the local community and subdistrict office were coordinating.
Tenant: How the power is restored is your business.
Ms. He: Stop arguing.
Tenant: Why should I not argue here? I have so many stores closed there right now.
At present, the park is managed by Zhonglin Meihao Property Management under the new landlord. After waiting for more than an hour, Ms. He left first because she had other matters.
Mr. Jiang, the person in charge of Zhonglin Meihao Property Management, came forward to respond. He said that after the auction in March, they had communicated many times with Ms. He's company, Wanxu.
Mr. Jiang, person in charge of Jinhua Yiwu Zhonglin Meihao Property Management: In the middle, we communicated at least ten or twenty times, but they never paid the rent. By August 27, under community mediation, a preliminary mediation was formed, and in the end they only paid the first rent payment of 1 million yuan on August 28. According to the agreement, on September 10 they paid another 500,000 yuan in rent, paying us a total of 1.5 million yuan. But under the entire contract, our annual rent is 3.38 million yuan, so later they still owed us 1.88 million yuan in rent.
Mr. Jiang said Ms. He's company signed three lease contracts with the previous landlord in total. The most recent one expires in May 2029, and the other two expire in April 2031. However, the two sides had previously negotiated that the annual rent would be performed according to the original contract, which means that for the rent after April or May next year, both sides still need to talk again.
Mr. Jiang, person in charge of Jinhua Yiwu Zhonglin Meihao Property Management: Later we learned that they collected at least more than 3 million yuan from merchants, and much of the money they collected had already exceeded the contract scope, with collections extending to July, August, and September 2027. This led to one concern for us: they collected a lot of money beyond the contract, so we proposed whether there could be collateral held with us, so that later disputes with merchants could be avoided as much as possible. Because after they clear the premises, the remaining tenants will definitely look for someone to discuss these matters, and we are afraid the disputes later will grow bigger and bigger.
Mr. Jiang said that Ms. He's company had previously proposed clearing the premises early and still owed one month's rent. Cutting off power was also a last resort. The property management also provided affected tenants with free office space.
Mr. Jiang, person in charge of Jinhua Yiwu Zhonglin Meihao Property Management: After this matter is resolved, merchants can choose on their own whether to move back to the office or do something else. They make the choice. But this matter has never been resolved. Since August, their person in charge has not come forward to resolve it or come to communicate. Every time it was the employees below who came to communicate. The annual rent is 3.38 million yuan. He has now paid 1.5 million yuan in total. Calculated according to this contract, he could only use it until September 10. They have a claim that they want to use it until November 19, because they converted the deposit and property fees entirely into rent.
The interview date was October 8. Mr. Jiang said that after coordination by the subdistrict office and community, the person in charge of Ms. He's company would come to communicate together later.
Mr. Jiang, person in charge of Jinhua Yiwu Zhonglin Meihao Property Management: Now the power has all been restored. We also hope their person in charge can come back on time to communicate about this matter and resolve it as soon as possible.
